TERMS & CONDITIONS OF HIRE

1. General Terms

1.1 Hired equipment will remain the property of Arcades2U at all times.

1.2 During the period of hire, the Hirer is solely responsible for the hire goods and must hold insurance to cover any loss or damage. Arcades2U holds full public liability insurance.

1.3 The Hirer undertakes to keep the hired goods in as good an operating condition as they were on the Start Date (fair wear and tear only accepted) and to return all equipment to Arcades2U in such order and condition.

1.4 Stickers and branding cannot be used without the prior permission of Arcades2U. When permission is given, all equipment should be returned as supplied. Nothing can be attached to the machines without the permission of Arcades2U.

1.5 Settlement of the account is strictly prior to delivery unless otherwise agreed in writing by Arcades2U. 100% of the agreed price must be forwarded with your order to allocate stock and confirm your booking. At the very latest, this payment must be made 10 working days for cheques and 5 working days for BACS / Faster Payment prior to the hire Start Date.

1.6 When equipment is ‘dry hired,’ it will be set up at our base or a delivery point and demonstrated as working, at which point the job sheet will be signed off. Should the equipment demonstrate faults after being moved by the customer, Arcades2U cannot accept responsibility under our refunds policy; however, we will provide phone support to try and rectify any issues.

2. Delivery / Installation / Removal

2.1 Arcades2U will endeavour wherever possible to ensure that pre-agreed delivery and collection times are adhered to. However, Arcades2U cannot accept responsibility for late deliveries or collections due to unforeseen circumstances.

2.2 Arcades2U warrants that the hire equipment shall be of satisfactory quality and fit for any purpose held out by Arcades2U.

2.3 Unless otherwise agreed in writing, the hired equipment will be delivered to a ground-floor location. Deliveries will be made in a 3.5-tonne van, so the Hirer must ensure appropriate access to the venue is available on the day. Should the event space require access via a lift or stairs, this should be advised by the Hirer prior to delivery and may be subject to an additional charge. If delivery requires stopping on a public road or incurs parking fees or fines, the Hirer is responsible for paying these. Arcades2U reserves the right to refuse installation of the hired equipment should it feel the location is not suitable or safe to do so.

2.4 An additional charge may apply for wait time if a site is not available for set-up at the time stated for delivery. An additional full day hire fee may apply if items are not ready for collection at the date/time stated on the booking confirmation.

2.5 In the event of any equipment requiring repair as a result of the Hirer’s negligence, misuse, or abuse, the Hirer shall bear the cost of any such repair.

2.6 In the event that the goods are damaged beyond economical repair or are lost, the Hirer shall bear the full write-off cost. The Hirer shall report to Arcades2U in writing within 48 hours of the event any damage to or loss of equipment. Write-off costs for each product are available upon request.

3. Cancellation / Non-Payment Policy

3.1 Once accepted and signed, our booking confirmation becomes a contract and is subject to the following cancellation fees:

  • Cancelled between 6 and 12 months of the event: 10% of hire charge
  • Cancelled less than 6 months and more than 28 days of the event: 50% of hire charge
  • Cancelled less than 28 days and more than 14 days of the event: 75% of hire charge
  • Cancelled less than 14 days of the event: 100% of hire charge

3.2 All deposits are non-refundable.

3.3 This cancellation policy applies to all aspects of this contract but excludes any custom, printed, or bespoke items, which are non-refundable once signed.

3.4 You acknowledge that Arcades2U shall not be responsible for any loss of or damage to the hired equipment arising out of or in connection with any negligence, misuse, mishandling of the equipment, or otherwise caused by you. You will indemnify us against any third-party claims or proceedings arising out of, or in connection with, any failure by you to comply with these terms.

3.5 In accordance with late payment legislation, Arcades2U charges debt recovery costs and interest on late payments (the Bank of England Reference rate plus 5%). Interest will accrue daily on your outstanding debt from the date the debt became due.

3.6 Arcades2U reserves the right to terminate this contract with immediate effect and to repossess any or all of the equipment if you breach the contract or if proceedings are commenced questioning your solvency. Such termination does not affect our right to recover any money due under this contract or damages for breach of contract.

3.7 You authorize us as your agent to enter any land or premises where we believe any equipment to be in order to inspect or repossess it.

3.8 Any failure by us to enforce any or all of these conditions shall not amount to or be interpreted as a waiver of any of our rights.

4. Refunds Policy

4.1 All deposits are non-refundable.

4.2 Should any of our machines break down over the course of your event or arrive damaged due to no fault of yours or your guests, Arcades2U will refund this machine(s)/item(s) on a pro-rata basis.

5. Disclaimer

5.1 Arcades2U reserves the right to substitute any goods for appropriate alternatives in the event that the actual goods quoted for are not available.

Kindly refrain from making a booking with Arcades2U unless you fully accept and agree to these terms and conditions.
